A New Historical Perspective of the Legal Status of Taiwan, Diaoyutai, and the South China Sea is now available

Man-Houng Lin, Research Fellow of the Institute of Modern History, Academia Sinica, publishes A New Historical Perspective of the Legal Status of Taiwan, Diaoyutai, and the South China Sea on September 7, 2017. The whole book analyzes the relation between the Taipei Treaty (the Sino-Japan Peace Treaty) and the sovereignty of Taiwan, Diaoyutai, and the South China Sea, and the reason why this relation is rarely noted by people in and out of Taiwan. The author takes an Asia-Pacific perspective, with reference to international laws as well as theories of historical memory and social myth, to undertake thorough analysis in lucid Chinese and English. In contrast with the 2008 version entitled A New Historical Perspective of Taiwan’s Legal Status, in addition to doubling of book length, its contents increase in the areas of: 1) national currency and textbook discussion; 2) the contribution that Taiwan could make for the East China Sea and the South China Sea issues, which are vital to the ongoing Asia-Pacific security; 3) the preparation done by Articles 4 and 26 of the San Francisco Peace Treaty for the Taipei Treaty; 4) the background for the application scope of the Taipei Treaty to have been set at the present and future effective area under the control of the Republic of China. More importantly, it points out that the Taipei Treaty is a national law of the Republic of China passed by its Executive Yuan, Legislative Yuan, and announced by the President, based on Article 63 of the Republic of China Constitution. It is also an international treaty registered as no. 1858 of year 1952 of the United Nations Treaty Series.
